How dealers can embrace AI without increasing compliance risk

With the vast and intense rise of artificial intelligence transforming dealership operations, compliance is becoming more complex than ever. On the latest episode of Training Camp, Jim Ganther, President of Mosaic Compliance Services, joins us to discuss how technology is changing dealership liability, why AI requires greater oversight and how compliance can become a long-term competitive advantage.

According to Ganther, compliance has evolved dramatically over the past two decades, largely driven by advances in technology and digital communications. Today, dealers are responsible not only for traditional advertising and sales practices, but also for every communication employees make on behalf of the business. 

“Our primary focus is in continuing the evolution of compliance. And compliance in the industry is an industry within the industry…. We’re all going very clearly in the same direction, and I think that direction ultimately is good for the entire industry.” 

He warns that social media posts, text messages, and other employee communications can expose dealerships to liability if they contain misleading information or omit required disclosures. Since dealers are ultimately responsible for employee actions, Ganther recommends limiting communications to monitored channels and implementing stronger oversight. 

AI offers opportunity & risks

While Ganther views AI as an incredibly valuable business tool, he cautions dealers against relying on it without human oversight. He points to AI-assisted lending decisions, hiring practices and advertising as areas where dealerships could unknowingly violate discrimination or advertising laws if AI-generated recommendations are accepted without review. Rather than replacing employees, Ganther says AI should function as a research assistant or thought partner whose work is always verified by people.

Drawing from his own legal practice, Ganther explains that AI has dramatically accelerated legal research while still requiring attorneys to validate every result before acting on it.

On the other hand, Ganther counters that the compliance industry itself has undergone significant transformation. What began as individual consultants specializing in narrow areas such as F&I, auditing or data security has steadily evolved toward full-service compliance providers.

As dealerships seek simpler vendor relationships, Ganther says the industry is increasingly consolidating into comprehensive compliance platforms capable of addressing variable operations, fixed operations, auditing and cybersecurity under one roof.

Making virtue profitable

Closing the conversation, Ganther argues that compliance should not be viewed simply as avoiding regulatory penalties but as a foundation for building stronger businesses.

"We're kind of becoming where the industry is going."

Referencing Mosaic’s long-standing motto, “making virtue profitable,” he says dealerships can achieve lasting financial success while operating ethically. He points to dealer groups that use their business success to positively impact employees, customers and their communities, emphasizing that strong character ultimately creates sustainable profitability.
